Lohmann Sand & Gravel, French Pit, Permit No. M-2001-017 <br />Dear Mr. Scott, <br />ECVE) <br />'-'[1AY -10 2010 <br />Division (,f t :aciarraAiow, <br />740 Alining and Safety <br />Weld County Public Works has recently become aware of a pending reclamation release request from <br />L.G. Everist for its French Pit located in section 6, T2N, R67W. A portion of the French Pit is located <br />within the Saint Wain Creek floodplain, a FEMA designated floodplain. The flood hazard development <br />permit, FHDP-400, on file with Weld County shows several 6 foot tall berms located on the north side of <br />the French Pit along WCR 26. These berms potentially impact water surface elevations within the <br />floodplain. The mining activity itself potentially impacted the location of the floodplain boundaries as <br />shown on FEMA's Flood Insurance Rate Maps. The DRMS should be aware that FEMA, the State of <br />Colorado Water Conservation Board, and Weld County have floodplain regulations which potentially <br />impact how the site can be used after reclamation. Pending CWCB regulations will make it so that all <br />state agencies will have to comply with the floodplain regulations. These agencies also have regulations <br />in place regarding the erosional stability of the fill that may be left in the Saint Wain Creek Floodplain at <br />the completion of mining. <br />In order to ensure that the mining activity has not adversely impacted the water surface elevations in the <br />floodplain and to show compliance with federal and state floodplain regulations, Weld County requests <br />that L.G.
