Pineda <br />Director <br />The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed and found the above referenced <br />report to be in compliance with the following regulations: <br />4.05.9(14)(b) - The impoundment has been maintained as designed, in accordance with the approved <br />plan and the applicable regulations. <br />4.05.9(15) - Certified inspection reports... shall include: Any appearance of erosion, instability, <br />structural weakness or other hazardous conditions. <br />4.05.9(17) - All impoundments shall be examined at least quarterly, by a qualified person designated <br />by the operator, for appearance of structural weakness and other hazardous conditions. <br />4.05.9(17) - A copy of the report shall be submitted to the Division on a quarterly basis. <br />The first quarter sediment pond inspection reports were received by the Division on April 5, 2010. Sediment pond <br />inspections were conducted by TMI on March 11, March 29, and March 30, 2010. <br />From the inspection reports, the identified maintenance items include: sediment removal in West Pyeatt #01 and filling of <br />burrows on the face of Industrial Waste Pond #01. The latter item may not be necessary but this embankment should be <br />monitored. <br />Per the report, all ponds were functioning as designed at the time of the inspections. <br />Per Rule 4.05.9(15)(d), these pond inspection reports should include the existing storage capacity of each impoundment. <br />Please add this item to future submittals, either in a summary table or on each report.
