Martin <br /> Executive Director <br />RE: Extension of the Decision Date for Amendment No. 01 (AM-01), <br />Wildcat Mining Corporation, May Day Mine, Permit No. M-1981-185. <br />Dear Party and/or Interested Person: <br />The Division of Reclamation, Mining and Safety (the Division) appreciates you taking time to participate in <br />the review process of the amendment to the May Day Mine permit. The amendment (AM-01) was filed <br />with the Division on April 6, 2010, by Wildcat Mining Corporation (the Applicant and/or Operator). <br />Through AM-01, the Applicant attempts to incorporate a new mine portal and milling facility at the <br />existing mine operation. <br />Due to the complex nature of the plans proposed in AM-01, the Division has extended the decision date <br />from May 6, 2010 to July 5, 2010. On or before July 5, 2010, the Division will issue its decision to approve, <br />approve with conditions or deny AM-01. The Division's decision will be based on whether the Applicant <br />has successfully demonstrated that AM-01 meets the requirements of the Colorado Mined Land <br />Reclamation Act, 34-32-101 et seq., C.R.S. (the Act or Hard Rock Act), and the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Board for Hard Rock, Metal and Designated Mining <br />Operations (the Rules). Copy of the current Act and Rules are available on the Division's web site at <br />www.mining.state.co.us. <br />Copy of the Division's decision document will be provided to all parties and interested person who <br />submitted timely comment or objection to AM-01. If you are one of the persons named in the Certificate <br />of Service for this notice, you will receive copy of the Division's decision document. <br />Pursuant to Rule 1.4.6(2), the Division will not schedule the matter for consideration by the Mined Land <br />Reclamation Board (the Board) unless the Division receives a timely petition for appeal of the Division's <br />decision, in accordance with the provisions of Rule 1.4.11. <br />Please contact me at the Division's office in Durango at 691 County Road 233, Suite A-2, Durango, <br />Colorado 81301, phone (970) 247-5469, if you have any questions. <br />Sincerely, o <br />Wallace H.
