MINE ID # OR PROSPECTING ID #: m-9n1n-n0g- <br />INSPECTION DATE: 4=93-9n1n INSPECTORS INITIALS: JI F <br />OBSERVATIONS <br />This was a pre-operation inspection of the Sikes Pit #2, DRMS file No. M-2010-008. This site is located 24 miles <br />southwest of Pritchett, Colorado in Baca County. I, Jared Ebert of the Colorado Division of Reclamation, <br />Mining and Safety (Division) conducted the inspection. Mr. Joe Baxter of Eastern Colorado Aggregates R.L.L.P. <br />accompanied me on the inspection. <br />The applicant submitted a 112c permit application for 67 acres on February 5th, 2010. The proposed permit <br />area encompasses a previously approved 111c operation (Sikes Pit; M-2009-080). The current operation is <br />located on top of a plateau. The northern permit boundary of the proposed site is located at the base of the <br />plateau. The new permit boundary is almost square shaped and is delineated with metal posts. The boundary <br />was measured and mapped using a Trimble GPS unit. A map of the Divisions findings is enclosed with this <br />report. The current delineated area encompassed 73 acres, six acres larger than the proposed permit area in <br />the submitted application. The applicant will need to re-survey and re-mark the permit boundary to <br />encompass the correct acreage. <br />A haul road has been improved to allow access to the current 111 operation. The road was measured to be <br />about 5,544 feet long from the scale house to County Road Q. The permit boundary marked for the 111c <br />permit area does not appear to be correct in terms of shape and size. That boundary encompasses about 22.6 <br />acres not the currently approved 27 acres. The 111c permit area includes 3,400 feet of the current <br />constructed haul road approximately 3 acres in size to make the total approved permit area 30 acres. The <br />current affected land was measured to be about 11.5 acres plus 3.2 acres for the improved haul road, for a <br />total disturbance area of 14.7. Given the incorrect shape and size of the marked boundary for the 111c <br />operation and the location and length of the haul road the operator may have affected land outside of the <br />approved boundary. <br />The proposed permit boundary will encompass the majority of the current mining disturbance; however it <br />does not include the area for a portion of the haul road. Based on the Divisions measurements the Operator <br />will need to modify the current proposed plan to include the haul road starting from where it enters the <br />northern permit boundary to where it connects with County Road Q; approximately 2600 feet. An additional <br />adequacy review addressing this issue will be sent to the applicant. The applicant will be given two options: <br />1.) They can submit an amendment to the currently submitted permit application with an updated <br />permit acreage to account for the area of the haul road. This would increase the proposed permit <br />area by about 1-2 acres. The applicant would need to update the 112c application pages and <br />exhibits to account for this area. This will constitute a new filing with the Division and the time for <br />review will start over in accordance with Rule 1.8. The applicant will be required to publish and <br />mail a new notice of the application in accordance with Rule 1.6.6. The Applicant will not be <br />required to submit a new application fee. <br />2.) They can submit a Technical Revision to the current application with a modified permit area that <br />would include the acreage for the haul road but would not change the total permit acreage. Thus <br />the acreage necessary will need to be removed from a portion of the proposed permit area to be <br />applied toward the haul road.
