2.) The Division was unable to locate the fence identified in the legend and in Exhibit S <br />of the application. Please depict this fence on the map. <br />6.4.4 EXHIBIT D - Mining Plan <br />3.) It states in item (e) (ii) that mining and affected land will range between 14.29 acres <br />and 15.69 acres with a maximum of 15.69 acres being disturbed at any one time. <br />However, item (d) indicates 30.92 acres will be the maximum area of disturbance at any <br />one time. Given the three phase mining plan and the size of each phase 30.92 acres <br />seems more appropriate. However, item (f) indicates the operator is proposing a <br />floating bond for 31.38 acres. Should not the maximum affected land be 31.38 acres to <br />match the floating bond proposal? Please clarify/explain this discrepancy. <br />4.) Will overburden be stripped to facilitate mining? If so, to what depth will it be <br />removed and where will it be stockpiled if kept on site? Overburden must be stockpiled <br />separately from topsoil. Please indicate where any overburden stockpiles will be <br />located on the Exhibit C map. <br />6.4.5 EXHIBIT E - Reclamation Plan <br />5.) The applicant states they will follow the NRCS recommendations for fertilizer <br />requirements. The NRCS indicates a soil test should be done to determine the type and <br />quantity of fertilizer to use. Please commit to conducting a soils test to determine the <br />appropriate type and quantity of fertilizer to use for reclamation. <br />6.) Exhibit L includes a cost for placing and crimping 2000 pounds per acre of straw <br />mulch at the site, however this is not mentioned in the reclamation plan. Please clarify, <br />does the operator intend on mulching the site? <br />6.4.6 Exhibit F- Reclamation Plan Map <br />7.) This map must be signed by the registered land surveyor, professional engineer, <br />and/or qualified person who prepared it. <br />6.4.19 EXHIBITS- Permanent Man-Made Structures <br />8.) Exhibit S indicates there is one ranch fence located near the site. Exhibit C indicates <br />there is an existing fence in the legend; however, the Division was unable to locate the <br />fence on the Exhibit C map. Is this fence located within 200 feet of the affected land? If <br />so, the Operator must:
