Michelle Hatcher <br />May 3, 2010 <br />acres of Pasture grass, all of which has been taken out of production. The historic consumptive <br />use of the 1 share was determined to be 50.5 acre-feet. The prorata historic consumptive use for <br />0.25 shares is 12.6 acre-feet. <br />Weld County has obtained a lease from SVLH for 26.0 acre-feet and a copy of the lease is <br />attached to this letter. This lease will be used to replace depletions in April and May 2010. The <br />amount leased from the SVLH includes a transit loss of 0.25% per mile for the 12 miles between <br />the pit location and the discharge point for the SVLH water. <br />Weld County has a perpetual lease with Greeley for the right to use up to 300 acre-feet per <br />year of Greeley's reusable effluent. This perpetual lease is used by the Weld County for several <br />projects. As shown on the attached Table 4, 16.26 acre-feet will be used in February and March <br />2011 to replace depletions from the Hokestra Pit. A copy of the Greeley lease is attached to this <br />letter. The reusable effluent will be released from the Greleey's Wastewater Treatment Plant <br />("WWTP") which is located on the south bank of the Cache La Poudre River in the SW1/4 of the <br />SW1/4 of Section 4, Township 5 North, Range 65 West of the 6th P.N, in Weld County. <br />A monthly breakdown of depletions and replacements is shown on the attached Table No. 4 <br />that was submitted with your report. <br />Conditions of Approval <br />I approve the proposed substitute water supply plan in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This plan shall be valid for the period of April 1, 2010 through March 31, 2011, unless <br />otherwise revoked, modified, or superceded by decree. If this plan will not be made <br />absolute by a water court action by the plan's expiration date, a renewal request must be <br />submitted to this office with the statutory fee (currently $257) by February 15, 2011. <br />2. Well permit no. 63693-F was issued in accordance with C.R.S. § 37-90-137(2) and (11) and <br />is valid for the current uses. The Applicant is required to maintain a valid well permit for the <br />current uses at this site. <br />3. The total surface area of the groundwater exposed at the Hokestra Pit must not exceed 67.9 <br />acres (exposed after December 31, 1980) resulting in a maximum annual evaporative loss of <br />173.3 acre-feet. <br />4. The reclaimed area irrigated from the lakes shall not exceed 5.65 acres with a consumption <br />not to exceed 9.65 acre-feet. <br />5. Total consumption at the Hokestra Pit must not exceed 182.9 acre-feet per year, unless an <br />amendment is made to this plan. <br />6. Approval of this plan is for the purposes as stated herein. Any additional uses for which the <br />water may be used must first be approved by this office. <br />7. The replacement water that is the subject of this plan cannot be sold or leased to any other <br />entity. As a condition of subsequent renewals of this substitute water supply plan, the <br />replacement water must be appurtenant to this site until a plan for augmentation is
