The amendment is to address issues noted as needing to <br />be addressed in Mined Land Reclamation Board Orders MV-2009-023 and MV-2009-024. Specifically the <br />amendment is to address sedimentation and stormwater controls at the mine site and to incorporate <br />additional area into the storage/ stockpile area. <br />Staff has reviewed the application and it appears complete for review. Per Rule 1.4.6(1) the decision <br />date is thirty (30) days from the date of this letter which is June 3, 2010 provided all issues have been <br />addressed. However, Colorado Stone is under a Board Ordered stipulation that the amendment be <br />approved by June 1, 2010. <br />Per Rule 1.6.2(d) Colorado Stone must publish a public notice in the local newspaper once within ten <br />days of this letter. The public comment period shall run 10 days from the date of publication. Please <br />inform staff as soon as possible of the publication date by phone or e-mail so that the public comment <br />period can be clearly established. The affidavit of publication can be submitted once the publication has <br />run. <br />An Adequacy Review will be forth coming as soon as staff can work it into the schedule.
