p.1 <br />Attention: Mr Berry, Mr. Fulton. And Mr. Klein: <br />This is what the landowner wants to put an end to all of this fighting, letter writing, and constant <br />disputes. <br />This, however, does not mean that we are not suing for the damages that have already been done. <br />We still will be suing for the theft of our topsoil, the irreparable damages that have been done <br />and the total disregard and neglect that happened from both the DRMS and Western Fuels. This <br />is what needs to be done now to settle the disputes that are happening every day. <br />A PLAN needs to be developed. Here is what the PLAN needs to say: <br />First off, throw TR57 out the window because it is illegal. 2', throw PR 6 out the window <br />because it is also illegal. <br />The land owner wants all the laws, rules and regulations followed. Treat Prime Topsoil and <br />Prime farmland as it deserves to be treated. Separate A lift, B lift, and C which is the underlying <br />soils that have been labeled Bench 1. These do not have to be stockpiled. C lift can go right <br />along the berm as it has been, EXCEPT ON OUR PROPERTY! DO NOT REMOVE ANY <br />SOILS OFF OF THIS PROPERTY. <br />We have some TOPSOIL that is 72 inches DEEP. If you take it off of here, it must go back <br />here!!! ! ! ! This PLAN is real simple. WFC enters the property, stock piles segregated, removes <br />their coal, put our soils back, grade, level, final grading, and then RETURN ALL of our prime <br />farmland back to irrigated crop land as it was. Not very hard is it? If there is not room for <br />everything to return to the hole, take the scoria and black spoil and give it to the neighbor or put <br />it in the deep swells and voids that THEY have EVERYWHERE. Put our property back the way <br />it was and give us our soils and Bench 1 that were here when they entered the property. Simple, <br />follow the laws governing Prime Farmland and quit allowing Marcia and Sandy to make up rules <br />as they go along. When I say we have TOPSOIL 72 inches deep, that is EXACTLY what I mean, <br />BARX DARVEY TOPSOIL and if you think for a minute we are going to settle for a <br />MINIMUM of 48 inches, think, again. IF IT CAME OFF OF HERE, PUT IT BACK. <br />Now, that is a PLAN of removal and reclamation that will stop all of this fighting except for the <br />law suit that is coming up for stealing our prime top soil and not following the laws to begin <br />with. <br />Involve the landowner in any decisions that are being considered for his property.
