p.4 <br />_. ------- <br />f <br />applicable, the names and addresses of every officer, partner, director, or person performing <br />a function similar to a director, of the applicant, together with the name and address of any <br />person owning of record ten percent or more of any class of voting stock of the applicant <br />and' a list of all names under which the applicant, partner, or principal shareholder <br />previously operated a surface coal mining operation in the United States within the <br />five year period preceding the date of submission of the application; <br />(fj ent of whether the applicant or any subsidiary, affiliate, or person contro ed by or <br />under corn control with the applicant has ever held any federal or state min <br />for surface coa mining operations which, ' the five-year perio a of <br />submission of th application, has b s d d or re ked or has h n' bond or <br />similar security e e lieu o n o t and, a b of n of the facts <br />o <br />(g) A copy of the licant tification o be ublz ed ' ewspaper of general c rculation <br />in the locality of a propos?t least once a r four successive we , which <br />otification shall i lude the names of every legal o er o , ord of grope (surface and <br />ineral) in the oposed site, a description of the exac loca ' oundaries of the <br />proposed site sufficient so that the proposed operation is readily locatable by local <br />residents, and the location at which the application is available for public inspection; <br />(h) A description of the type and method of surface coal mining operation that exists or is <br />proposed, the engineering techniques used or proposed, and the equipment used or <br />proposed; <br />(i) The anticipated or actual starting and termination dates of each phase of the surface coal <br />mining operation and the number of acres of land to be affected; <br />0) An acciiiatd map or plan, of an appropriate scale, clearly showing the land to be affected as <br />of the date of the application and the area of land within the permit area upon which the <br />applicant has the legal right to enter and commence surface coal mining operations and a <br />statement of those documents upon which the applicant bases such legal right to enter and <br />commence surface coal mining operations on the area affected and whether that right is the <br />subject of pending court litigation; except that nothing in this article shall be construed as <br />ction to adjudicate property rights disputes; <br />(k) The name of the watershed and location of the surface stream or <br />surface and pit drainage will be discharged; <br />(1) A determination of the probable hydrologic consequences of the surface coal mining and <br />reclamation operations, both on and off the mine site, with respect to the hydrologic regime <br />and the quantity and quality of water in surface and groundwater systems, including the <br />dissolved and suspended solids under seasonal flow conditions and the collection of <br />sufficient data for the mine site and surrounding areas, so that an assessment can be made <br />by the office of the probable cumulative impacts of all anticipated mining in the area upon <br />the hydrology of the area and particularly upon water availability; <br />July 1, 1995 9 34-33-110(2)
