Stark <br />Environmental Protection Specialist <br />Colorado Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br /> <br />MAY 0 5 2010 <br />D vWbn of m6caam2Non, <br />wong WW &*r tj <br />Re: 12 April 2010 CDRMS Inspection Report for Colowyo Mine, C-1981-019. <br />Dear Mr. Stark: <br />After review of the April 2010 CDRMS Inspection Report, Colowyo has the following <br />comments: <br />Page 2 of 4 - Hydrologic Balance: <br />It has occurred to Colowyo that a misunderstanding has taken place between <br />Colowyo and the DRMS Inspector during the last couple of inspections in regards to <br />sampling of Outfalls for Settleable Solids. Colowyo stringently requires its contract <br />lab (IML) to routinely test, not only for Total Suspended Solids, but for Settleable <br />Solids and all other parameters set forth in its Colorado Wastewater Discharge <br />Permit # CO-0045161 for each testable discharge. The sensitivity of IML's tests for <br />Settleable Solids reaches a minimum analysis limit of 0.2 ml/I/hr which is well below <br />Colowyo's alternate limit of 0.5 ml/I/hr, which Colowyo can claim if the pond exceeds <br />the original effluent discharge limitations caused by inflow into the Outfall because of <br />precipitation or snowmelt within any 24-hour period. Colowyo would like the Division <br />to note Colowyo's diligence in testing for Settleable Solids whenever necessary. <br />Page 3 of 4 - Hydrologic Balance (cont.): <br />Colowyo requests that, if the Division is going to continue to mention the five (5) <br />sumps located in Taylor Draw, they be specifically and clearly labeled as Best <br />Management Practices (BMP's) in the report. These sumps are not permitted <br />structures and will be managed and maintained as such.
