Dear Mr. Hunt,
The Colorado Department of Public Health and Environment ("the Department"), Hazardous Materials
and Waste Management Division ("the Division") received correspondence from Adams County on
February 17, 2010. The correspondence included: (1) a memorandum from Adams County Planning
and Development Department dated February 12, 2010 requesting the Division's review of the subject
Certificate of Designation ("CD") application, (2) a document entitled "Certificate of Designation,
Operations and Closure Plan for Speer Inert Landfill, Adams County, Colorado" dated May 2009 ("the
Plan"), and (3) "Addendum to Certificate of Designation Operations and Closure Plan for Speer Inert
Landfill, Adams County, Colorado," prepared by Asphalt Specialties Company, Inc., ("ASCI") dated
January 25, 2010. The Division conducted a completeness review of the Plan in accordance with
procedures outlined in state statute, CRS 30-20-103 et seq., and corresponding Regulations Pertaining
to Solid Waste Sites and Facilities, 6 CCR 1007-2, Part I ("the Solid Waste Regulations"). By its
letter dated March 11, 2010 the Division notified ASCI that the Plan was incomplete. On April 20,
2010, the Division received Revision 1 to the Plan dated April 2010 ("Revision I"). The Division
conducted a completeness review of Revision 1 and finds Revision 1 to be substantially complete.
Please note that the Division's decision concerning completeness only indicates that Revision 1
generally addresses the major requirements in the Solid Waste Regulations. The Division's decision
concerning completeness does not imply or indicate anything about the outcome of the comprehensive
technical review, nor does it preclude the Division from requiring the applicant to provide additional
information or clarification of items in the application. In fact, based on our preliminary review of
Revision 1, the Division requires additional information and/or more detail regarding, but not limited
to, the following listed issues/comments. The Division's preliminary comments are provided herein
proving the health and environment of the people of Colorado
