During the Informal Conference, Mike Morgan commented that the elevation of the <br />reclaimed northern end of the Benson -West property is higher than the pre- mining <br />elevation was, blocking the view to the North from "Sunshine Corner ". During the <br />discussion on 16 March, WFC indicated that, at Mr. Morgan's request, the reclaimed <br />elevations of the Morgan parcel will be such that a pivot system could one day be used to <br />cover both mined and un -mined portions of his property. The increase in backfill volume <br />(swell) that would otherwise have occurred on the reclaimed Morgan property has thus <br />been transferred to the Benson and Lloyd parcels. The text of the Permit does not reflect <br />this information. Please revise Section 2.05.4(2)(c) Backfill and Grading to explain the <br />increased post- mining elevations proposed for the Lloyd and Benson -West parcels. <br />84. At the informal conference and in correspondence, Mike Morgan also expressed concern <br />about the possibility of spoil springs developing on the property to the north of the <br />Morgan property. Please evaluate the possibility of spoil springs developing and <br />discharging as a result of the elevation changes which could impact water quantity and <br />water quality. This discussion should be added to the discussion of Probable Hydrologic <br />Impacts. <br />Please provide responses to this letter and the January 22, 2010 initial PAR by April 19, 2010. <br />Pursuant to Rule 2.07.4(2), the Division is required to make a proposed decision no later than 60 <br />days after the informal conference which is April 19, 2010. For good cause shown, the Division <br />may extend the time for the proposed decision up to an additional 60 days.
