Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division has reviewed your February 8, 2008 response letter to our Preliminary <br />Adequacy Review (PAR) for TR-55. The status of the concerns identified in our PAR <br />letter is as follows. <br />1. A reclamation bond rider with updated legal description corresponding with the <br />TR-55 amended permit area legal description requested by the Division has not <br />yet been received. Snowcap Coal Company indicates that the updated rider <br />has been requested from their surety company, and that it will be forwarded <br />to the Division upon receipt. <br />2. A copy of the newspaper proof of publication for TR-55 was properly submitted <br />to the Division on January 30, 2008. Item Resolved. <br />3a. On p. 12-3, the reference to 243 acres of disturbed land was properly revised to <br />242 acres, to correspond to table 3-7. Item Resolved. <br />3b. Also on p. 12-3, the reference to 3,523 acres affected by undermining was <br />properly clarified, by including explanation that a significant portion of the <br />acreage was included in the SL-3 liability release, leaving a total of 1,385 affected <br />acres within the amended permit boundary. Item Resolved. <br />3c. Table 12-2 was amended as requested, for clarification and consistency with other <br />tables and text.
