We also understand that according to the Permit Renewal section of the Overview Report on the DRMS
-?n
website, there are provisions operators to-take two 5-year periods of temporary cessation after which
they either need to reinitiate operations or begin reclamation. Does this mean they can simply "take
off" for ten years and restart operations without going through the permit process again?
According to Colorado Division of Minerals & Geology Report dated 4/22/2010, there are 13 other gold
and/or Silver mines listed in La Plata County with currently four, including one of the Mayday Mine
permits, indicating their status as active. A concern for the citizens that enjoy La Plata canyon is that
further approval of activity by WMC may precipitate the inclusion of ore being processed from those
other mines in La Plata County at the Mayday/Idaho mill location. Besides requiring a greater fee for
surety, is approval of increased activity to any such magnitude a possibility in the eyes of the DRMS?
Installing an unpermitted mill facility in an unpermitted portal seems a direct aff ront to the Rules and
Regulations as sefbnforced by the DRMS. This activity has occurred since any previous inspection which
is assumed to be less than four years. With "the MLRB directing the Minerals Program to inspect each
permitted mine site at least once every four years", we ask how often inspections to this particular site
are scheduled?
We respect fully the fact that WMC has a right to profit from gold mining and that a legal permit exists
for mining operations at the Mayday Mine, but that privilege has to occur within the range of acceptable
activities as defined by overseeing government organizations. Laws, rules and regulations have been
established to protect people and the environment. After repeated offenses to many agencies, the
question remains; at what point does this activity and lack of respect for governing agencies become
criminal? With its history of transgressions, we oppose the approval of further activity at the Mayday
Mine.
Sincerely,
lee, 1 /
Ken and Veniece Fagerlin
Mayday Residents - 4398 CR 124, Hesperus, CO 81326
