Cattany <br />Division Director <br />City of Greeley Natural Resource Trustee <br />1100 10' St., Ste. 202 <br />Greeley, CO 80631 <br />Re: Bestway Paving Company Pit No. 1, Permit No. M-1977-315 <br />Your Letter Dated May 20, 2005 <br />Dear Mr. Whitley: <br />In your May 20, 2005 letter to the Division, you requested a written response as the City of Greeley has <br />informed the applicants that the final subdivision will not be approved until we are satisfied that the subdivision <br />will not conflict with the Division of Minerals and Geology's reclamation plans for the property." <br />The permitted post-mining land use for the site is industrial/commercial. On June 21, 2005, the Division <br />inspected the referenced site to determine if reclamation had been achieved. The Division found that without <br />improving stabilization of the pit floor with the addition of road-base-quality gravel, removing or burying <br />exposed concrete, and reseeding the stockpiles and portions of side slopes to meet the revegetation <br />standard, the subject mine site cannot be released from reclamation responsibility as an industrial/commercial, <br />site. Please see the enclosed inspection report. <br />The Division cannot release the site under the assumption that future plans will be executed, as there is <br />currently no guarantee as to when or if they will occur.
