In that, report you said the <br />"Affected acres appear to exceed 30 acres maximum allowed at any given time." The corrective <br />action that you requested was that the "Operator will submit a technical revision, removing the <br />phased portion of the plan and increase the maximum affected acres to 60 acres from the current <br />30 acres, and post the appropriate warranty." The operator is complying with your request and is <br />submitting this document as confirmation that the operator is in agreement with all of the <br />Divisions suggested corrective actions. <br />The operator had the permit area surveyed by Cardinal Land Surveying, Inc. the supplementary <br />MINING AREA SURVEY map is enclosed for the Division of Reclamation, Mining and Safety <br />review and file. In addition, to the MINING AREA SURVEY the operator has used the survey map <br />to show the proposed mining areas as well as the non-mining areas this is the map used to <br />calculate the estimated increase in the financial warranty that is submitted with this report. The <br />operator believes the maps will help the Division of Reclamation, Mining and Safety determine <br />the compliance with the problem and the corrective action portion of the permit status. This will <br />enable the division to process our technical revision and set a new financial warranty amount. <br />The Cardinal Land Surveying, Inc. map indicates that the AFFECTED AREA- DISTURBED is <br />56.71 acres and that the affected AREA-EARTH SHAPED NO VEGETATION ESTABLISHED <br />30.78 acres. The terms used by the land surveyor where basic terms given by the operators <br />consultant L J DEVELOPMENT, INC. to establish the different states of reclamation present on <br />site. The following are the definitions are the approximate meanings: <br />AFFECTED AREA- DISTURBED: active and/or mined out areas and no reclamation has taken place. <br />AREA-EARTH SHAPED NO VEGETATION ESTABLISHED: non-active area that has been mined out <br />and the land has been shaped to final topography ready for seeding and final reclamation.
