(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1979-1.58_ <br />INSPECTION DATE: 4/14/1n INSPECTORS INITIALS: RK <br />OBSERVATIONS <br />The Division conducted joint monitoring inspection of the site as part of sites to be <br />inspected during the fiscal years 2010 and 2011. The site is a small 112 sand and gravel <br />operation located 3 miles South West of Colorado City shopping center. <br />Site was not active at the time of the inspection. Operator was contacted about the <br />pending inspection but was unable to attend. <br />According to Mr. Valdez, at present, the site is operated- by Pueblo County. During the <br />site visit a couple of front end loaders and a Pueblo County pick up truck was noted <br />along the south East side of the fenced permit area. <br />At the access to the property along the North East side an old grizzly was noted , in <br />addition either from surface water or localized GW, there is a small ponded water noted <br />Under the State Engineers Rule, the operation can only allow ponded water to be retained <br />on the surface for no more than 72 hours. Since the captured water is small in nature, <br />DBMS will not site is as a possible problem at this time, since the source of the water <br />is not established. However, if the source of the water is GW and the operator does not <br />have adequate water substitute supply plan, or an augmentation plan the Division advises <br />they contact the State Engineers Office, to obtain the appropriate permit to augment the <br />water. <br />The total permitted acres is 41.14 acres. The current financial warranty for the site is <br />$95,900.00 <br />An old grizzly was noted located along the NE side of the access gate. Permit sign was <br />properly posed at the access road to the permit area. The entire permit area is fenced. A <br />small diesel container was noted along the South east side of the pit area. It was <br />properly placed to control any spills. <br />Large processed stockpiled material was noted east of the active mining area. Two old <br />front end loaders and a Pueblo county pickup truck were noted during the inspection. <br />Active mining high wall along the west side appeared to be cut to approximate reclamation <br />slope of 3:1. The already reclaimed slopes along the North East side of the active mining <br />area orienting to the East were found to be vegetated and stable. No major sign of <br />erosion noted. What appeared to be top soil/overburden stockpiles noted along the south <br />side was stable. The operation is in compliance with the approved reclamation plan. <br />According to Mr. Valdez, Pat Coffee of Pueblo County informed him that as a Government <br />Agency, the operator might not need be required to post a financial warranty as it is, a <br />government Metropolitan District for the county of Pueblo. If the Metropolitan District <br />is indeed a Government Agency and meets the requirements of Rule 4.1.2(2) and C.R.S,34- <br />32.5-117(3)(VIII) of the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials 34-32.5-117(3)(VIII),such proof must be provided.
