Larimer Pit (M-1974-069, AM-2) <br />Reclamation Release <br />April 23, 2010 <br />Reclamation within the original permit area has taken place concurrently over the years as <br />mining has progressed. Site reclamation generally consists of sloped groundwater ponds/lakes <br />and meadows planted in native grass. Reclamation has been ongoing, correlating directly with <br />the completion of mining of each cell. <br />On December 21, 1977, Case Number W-7412 was filed in the State of Colorado District Court <br />for Water Division No. 1 augmenting pits 1, 3, 4, 5, 6, 9, and 11 (all south of Big Thompson <br />River) as referenced on Figure 1. <br />A Junior Storage Right was established for Loveland Ready-Mix Pond No. 1 (pit 16) and for <br />Loveland Ready-Mix Pond No. 2 (pit 17) on February 16, 2001, Case No. 98CW431. <br />On January 8, 2010, the final augmentation plan for the Larimer Pits lake surface area was <br />approved by Colorado State District Court, Water Division 1, Case OOCW142. This permanent <br />augmentation plan covers all current and future exposed water surface area in the Larimer Pit <br />permit not previously addressed in Case W-7412. <br />Upon completion of the permanent augmentation plan, Case OOCW142, there are no further <br />reclamation requirements for the areas of the Larimer Pit we are asking to be released through <br />this request. <br />Parcel Location and Description of Land Requested for Acreage Reduction <br />There are two land sites east of Wilson Ave and South of Big Barnes Ditch that LRM would like <br />to formally release under this notice. These two sites have not been included in the permitted <br />mining area for over 20 years. There is also a third site west of Namaqua Rd between Big <br />Barnes Ditch and the Big Thompson River that LRM would like to release under this notice. <br />These sites can be seen on the Figure 1. <br />The first site east of Wilson Ave is located south of Big Barnes Ditch and North of the Big <br />Thompson River, it encompass a total of 30.72 acres, with a 15.48 acre groundwater pond. This <br />is pit number 13 on Figure 1. The 30.72 acres on this site was originally reclaimed in the 1980's <br />by sloping the sides of the ground water pond and planting the area with native grass. The <br />native grass is well established. Cottonwoods and other trees have grown up around the <br />perimeter. LRM sold these two parcels in 2003 to Darlene Schuster, and U Schuster, LLC. The <br />current owners are currently building a residence on this site and have added a great deal of <br />additional landscaping. This site has not been included in the permitted mining area for over 20 <br />years. <br />The second site east of Wilson Ave is located south of the Big Thompson River and is owned by <br />the City of Loveland. The City purchased this parcel with 40 acres in 1984. It includes ground <br />water ponds 9 and 11 as shown on Figure 1. A City bike path runs between the Big Thompson <br />Page 2
