TRANSIT MIX AGGREGATES <br />April, 24, 2010 <br />Mine Land Reclamation Board <br />C/O Mr. Berhan Keffelew <br />Colorado Division of Reclamation Mining and Safety <br />1313 Sherman St. - <br />Suite 212 <br />Denver, CO. 80203 <br />Re: M-1977-211 Pike View Quarry <br />Dear Sir, <br />WRNEI) <br />APR 2 6 201,` <br />MAition o. <br />Uning and Safety <br />This letter is to request an extension of the order from the Mine Land Reclamation Board requiring <br />Continental Materials Corporation dba as Transit Mix Concrete Co., and Castle Concrete Co., to file an <br />amended reclamation and mining plan prior to May 13, 2010 for the above referenced site. <br />Our investigation is currently not completed and a new amendment has not been complete and can not be <br />completed by the above referenced date. In September of 2009 a second slide occurred further delaying the <br />investigation. As recommended by DRMS and the Colorado Geological Survey, a monitoring system has <br />been installed at the mine location with 34 prisms being monitored on an hourly basis 24 hours per day 7 <br />days per week. Information from this system has been passed along to both the DRMS and the CGS so <br />they are aware of the movement of the slide. All other safety precautions have also been implemented. <br />The original slide continues to creep within the permit boundaries. From a safety point of view we are <br />unwilling to put anyone in a situation that could have a catastrophic outcome. This has precluded Castle <br />from having the ability to complete the geological and geotechnical evaluation necessary for the submittal. <br />Within the next two weeks Castle Concrete will submit a Technical Revision to the DRMS outlining an <br />action plan with regard to further investigation of the slide. <br />Should there be further question, please feel free to contact me at your earliest convenience. <br />Castle Concrete Div.
