III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining and <br />Safety. No mine personnel were on site during the inspection. The weather was overcast and damp. The mine <br />site had received rain the night before with occasional light rains during the inspection. The mine site was wet <br />and muddy. <br />Roads: The access road was maintained though muddy. The access road to the RDA had waterbars cut into <br />the roadway. These cuts were proving effective in directing water to the ditch. Access road around the RDA <br />remained in good condition. The inspection did not attempt to access the South fan due to the muddy <br />conditions. The Vento parking area is graveled and in good condition. <br />Hydrologic Balance: Pond 5 was damp but not holding any water. Pond 4 was damp but not holding water. <br />Ditches throughout the mine site appear to be functional. The clean water diversion is well vegetated with no <br />standing water or gullying noted. <br />Revegetation: Vegetation establishment on the RDA and on the reclaimed facilities area is very good. No <br />active erosional features were encountered on the reclaimed areas. Vegetation throughout the permit area was <br />greening up. Species prevalent and showing signs of new growth included; yellow sweetclover, buffalo grass, <br />blue grama, fescue, rabbit brush, four-wing saltbush, juniper, Pinyon pine, mountain mahogany, little <br />bluestem, fringed sage, and cicer milkvetch. <br />Locations at the facilities area that had previously been flagged and sprayed for weed control do not show any <br />sign of noxious species re-emergence. <br />Wildlife: Songbirds and mountain bluebirds were very active throughout the site. Numerous elk tracks were <br />observed on the access road near the main entry gate. Mountain lion tracks were observed in the mud in the <br />reclaim tunnel. <br />Support Facilities: The load-out site is located off Fremont County road #79. The identification signs are <br />clearly posted at the load out. The Loadout is mostly revegetated with narrow travel corridors adjacent to the <br />rail on both east and west sides of the county road. Both load out ponds were damp with no standing water. <br />There were cut limbs stored on the west side of the Loadout.
