III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator during the records check and field inspection. <br /> Roads <br /> The paved main haul road was in good condition.The road's guard rail was in place.The east entrance graveled <br /> haul road also was in good condition.The east gate was open.The light use road along the tracks was passable. <br /> Signs and Markers <br /> The mine id signs were up at the main entrance,east entrance and near the railroad tracks.The required <br /> information was on each sign. Permit boundary markers were up as well. <br /> Hydrology <br /> There was a small volume of standing water in the east side sediment pond. The primary's gated valve was <br /> closed and the emergency spillway had sufficient capacity.Pond inslopes and the embankment outslopes were <br /> stable.The west side sediment pond was dry. The pond's combination spillway had enough capacity. <br /> The culverts were clear and the ditches had enough capacity.The silt fence and straw bales at the railroad track <br /> small area exemption were in place. <br /> Facilities <br /> There was only a moderate volume of stockpiled coal on the facilities bench.No problems with fugitive dust or <br /> coal dust being tracked onto the main highway were observed.The facility's outer edge protective berm was in <br /> place.There were no leaks at the fuel facility.No problems were observed at any of the loadout's coal handling <br /> structures, substation,material storage area and office. <br /> Topsoil <br /> The east side topsoil stockpile had a moderate vegetative cover. The topsoil signs were up on the stockpile.The <br /> collection ditch was well vegetated,as was the diversion ditch.The topsoil stockpile on the west side of the <br /> permit area had a good vegetative cover.Topsoil signs were up. <br /> Records <br /> The required loadout records were found to be in compliance.
