III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator during the field inspection. However,Bill Bear represented the operator during the records check.The <br /> site was mostly dry. There was no activity onsite. <br /> Signs and Markers <br /> The mine id sign was on its post at the top of the hill and contained the required mine information.The"records <br /> location"sign was also on the post. Surface disturbance markers were up along the disturbed area boundary. <br /> The"no trespassing" sign was on the entrance gate. <br /> Roads <br /> The paved entrance road was in good condition and was passable.The cable guard was up on the outside edge <br /> of the road.The bridge was also passable.The entrance road gate was open. <br /> Hydrology <br /> There was a little standing water in the sediment pond.The primary discharge pipe gate was closed. The <br /> riprapped emergency spillway was in place.The collection ditch leading into the pond had sufficient capacity <br /> and had a good vegetative cover. The hillside treatment pond was discharging at about 10 gpm into the river. <br /> The water was orange in color,which has been shown to be in compliance with water quality standards. <br /> The hillside spring water was flowing into its constructed channel and culvert and,then, into the treatment pond. <br /> There were no problems noted with the two alluvial wells.The riverside berm was in place. <br /> Reclamation <br /> The reclaimed west portal area continues to show signs of instability, such as further cracking in the backfill and <br /> backfilled highwall.There was an odor of smoldering coal in the backfilled west portal area. <br /> The reclaimed east side fan area was stable and had a good vegetative cover.The same was true for the <br /> reclaimed road leading up to the reclaimed fan area. <br /> Noxious Weeds <br /> There are still several tamarisk plants at the hillside spring area and near the entrance gate which need removal. <br /> Records <br /> The mine records were located at the Bowie No. 2 Mine office and engineering building and were in <br /> compliance, as documented on the attached records checklist. <br /> c:/word2007/bear3/insp04l O <br />
