III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the field inspection. On the day of the inspection, it was snowing intermittently at the higher elevations. <br /> West Mine <br /> The road from Steven's Gulch road to the reclaimed mine site was a little snow packed but was passable.The <br /> mine ID sign was at the former entrance to the site and had the required mine information.The backfilled and <br /> graded areas of the former mine bench and haul road were covered in light snow but appeared to be stable. <br /> There were no indications of slope instability or erosional problems. Surface disturbance markers defined the <br /> disturbed area. <br /> There was no standing water in either of the two sediment ponds.Both embankments appeared to be stable.The <br /> primary gated valve was closed in the lower pond and open in the upper pond, as designed. Both emergency <br /> spillways had the design capacity and the riprap was in place on the down slope. <br /> The buried culvert in the East Roatcap drainage was functioning properly. There was a considerable volume of <br /> water passing through it. Some of the silt fence in the northeast corner of the site will need repair soon. <br /> The reclaimed fan site was also covered in light snow.The area appeared to be stable.The silt fence will need <br /> repair soon.The mine id sign was up at the entrance but the gate was open.The road was wet but passable. <br /> East Mine <br /> The east mine had been recently reclaimed.There was light snow on the higher slopes. The entrance gate was <br /> locked and the mine id sign was on the gate.The sediment control was in place at the entrance. The dirt road <br /> was passable all the way to the top. <br /> The quality of the reclamation work at the east mine is impressive, especially considering the steep slopes.The <br /> reclaimed slopes were stable. There were no signs of erosional problems or slope instability. The roughened <br /> slope surfaces were holding up well. The lower slopes had some vegetative cover while the higher slopes were <br /> just starting to green up.The riprapped channels were neatly constructed. <br /> Unit Train Loadout <br /> There was no activity on site and no railcars were parked on the tracks. The three entrance gates were open and <br /> mine id signs were up on each of the three gates.The topsoil stockpile on the west end of the site was well <br /> vegetated and the topsoil sign was on the pile. <br /> The upland diversion series of culverts and ditches, located in the middle of the loadout bench,was functioning <br /> properly,with a considerable volume of water flowing through it.
