III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division). A major increase in activity at the site has <br /> occurred since the last State inspection. From discussions with Ron Thompson, Mine <br /> Superintendent, and verified through publically available sources, the parent company of <br /> New Elk Coal Company, Cline Mining, has closed on private placement financing in the <br /> amount of 35 million dollars to finance continued development and provide general working <br /> capital for day-to-day operations. Ground conditions on this day were dry and the weather <br /> was partly cloudy and seasonal. <br /> Roads <br /> The mine has leased a moderately sized road grader and was actively grading access roads, <br /> haul roads, and road ditches throughout the site. Upon arrival at the mine, a security guard <br /> was stationed at the mine entrance, providing safety training and check-in of all visitors. <br /> t . j <br /> 41 z <br /> » X _ <br /> 3 <br />
