The Applicant should be awarded the relief requested in the Application. <br />CONCLUSIONS OF LAW <br />8. The Application herein was timely filed and is one contemplated by law. and this Court has <br />jurisdiction over the subject matter of this proceeding. <br />9. Timely and adequate notice of the filing and of the contents of this Application was given. as <br />required by law, and this Court and. the Referee have jurisdiction over all persons or entities <br />affected hereby, whether they have appeared or not. <br />10. Since the original award of the conditional water rights described in Paragraph 3, above, the <br />owners of such water rights have tiled timely and proper applications for findings of <br />reasonable diligence for these conditional water rights, as required by law and by the decrees <br />entered with respect to these water rights. Pursuant to these applications, the District Court <br />for Water Division No. 4 has continued these conditional water rights in full force and effect. <br />I. The Applicant has shown reasonable diligence in the development of the conditional water <br />rights described in Paragraph 3, above. Therefore, the Application should be granted, and <br />these conditional water rights should be continued in frill force and effect. <br />RULING <br />12. The Findings of Fact and Conclusions of Law set forth above are hereby approved and <br />confirmed, and are incorporated into this Ruling by reference. <br />13. The Application. is hereby approved, and the conditional water rights described in Paragraph <br />3, above, are hereby continued in full force and effect. <br />1.4. Pursuant to Rule 9 of the Uniform Local Rules for All State Water Court Divisions, upon the <br />sale or other transfer of the Whitewater Pumping Station and Puckett Ditch conditional water <br />rights, the transferee shall file with the water court having jurisdiction a notice of transfer <br />which shall state: <br />A. The title and case number of the case in which the conditional decree was issued; <br />B. The description of the conditional water right transferred; <br />C. "l he name of the transferor; <br />D. 'Fhe name and mailing address of the transferee; and <br />F. A. copy of the recorded deed. <br />The owner of said conditional water right shall also notify the Clerk of the Division 4 NVater <br />Court of any change in hailing address, Me Clerk shall also place any notice of transferor <br />change of address in the case file for this case (Case N:). 07 CW 1471
