Bob and Garrett both indicated that from DWR's perspective, an <br />NOI would not be required for the Bradbury Pit. Garrett explained that an impoundment refers to a structure that <br />stores water above the ground surface and that an excavation for which an embankment or dam is not <br />constructed above ground surface is not considered an impoundment and therefore an NOI would not be <br />required. Bob and Garrett also both agreed that berms or other diversion structures should be constructed to <br />prevent upgradient surface water from entering the pit to avoid the potential for administration of the storage of <br />surface water, and as we have discussed, to prevent erosion of pit sideslopes. <br />If you have any questions or need additional information, please contact me. <br />Bill <br />William G.
