The <br />ground continues to slope to the south to Indian Creek (a dry wash). The Smith Ditch is <br />located 150 feet south of the property line at its closest point. See Exhibit B. A site visit <br />will give a better understanding of these features. <br />Exhibit D- Mining Plan <br />Exhibit E- Reclamation Plan <br />Exhibit G- Water Information <br />Exhibit J- Vegetation Information <br />Exhibit S- Permanent Man-Made Structures <br />I believe we decided that Exhibit F will work in its present form. <br />Bill Merrill with Western Water and Land spoke with Bob Hurford (Division Engineer- <br />Water Division 4) and Garrett Jackson (DWR Dam Safety Engineer) about the need to <br />file an NOI to construct a non jurisdictional water impoundment structure. It is there <br />opinion that the NOI is not required. See attached e-mail. <br />Enclosed is a Ruling of Referee and Decree concerning water rights owned by the <br />Tippings (owners of GJ Pipe) and others in the Gunnison River and a letter form our <br />attorney explaining water diversion form Kannah Creek for your information.
