energy fuels coal, inc.
southfield mine • post office box 459 • Florence, colorado 81226 • (719) 784-6395
April 23, 2010
Mr. Rob Zuber, P.E.
Colorado Division of Reclamation Mining & Safety
1313 Sherman St - Room 215
Denver, CO 80203
Dear Rob Zuber:
RECEIVED
APR Z 6 2010
DlVtmtCis i v rev t 'r`r0a:lF 3f1,
Mining &M Su*

In response to your email dated 04-01-10 asking about a 4 acre discrepancy for "Areas Approved as
Permanent" that you found in the 2009 Annual Reclamation Report (ARR), I am enclosing a corrected copy
of the 2009 Annual Reclamation Report for your review and file. Only the Summary of Disturbance Table
on page 5 of the report reflects the change for correction. Following is explanation of the discrepancy.
In reviewing our files, I saw in the 2005 ARR, it references, "Areas PENDING Permanence" in the
Summary of Disturbance Table (page 5).
Year 2005 was the era prior to requesting the change of Temporary status for Pond "F" to permanence,
(TR-22). The area effected was approximately 3 acres. Additionally, two road segments, the temp light
use road to the former Pond G area (north of the county road) and a segment of the mine entrance road
commencing at the intersection of CR 12E & the mine road were approved for Permanent Light Use status.
The permanence of the roads was approved in the Mine Permit Renewal, RN-05. The two road segments
make up the additional 1 acre totaling the 4 acre discrepancy that you found.
Although the 4 acres (the discrepancy) had been updated to permanent status in the summaries, I had
inadvertently overlooked updating it in the respective Annual Reclamation Reports (ARR's). It does not
change the subtotal or total acres of disturbance but does change the detail of the Areas Approved as
Permanent from 36.1 to 40.1 in the respective ARR's and reduces the "Reclaimed greater than 10 years"
line from 345.6 to 341.6 acres in the Summary of Disturbance Table (page 5). The table has been updated
to show these changes.
Thank you for bringing this to our attention.
Sincerely,
eorge V Patterson
General Mine Mgr
