ec5 y ZZ-/D <br />oar <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />/ORDER GRANTING CONTINUANCE <br />IN THE MATTER OF DUMB AND DUMBER TRiJCKING, LLC'S POSSIBLE <br />VIOLATION, CEASE AND DESIST ORDER, CORRECTIVE ACTIONS AND CIVIL <br />PENALTIES FOR FAILING TO POST ADEQUATE RECLAMATION BOND, File No. <br />tX4-2000-149 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on April <br />14, 2010 in Denver, Colorado for a hearing to consider a possible violation, Cease and Desist <br />Order, corrective actions and civil penalties for failing to post adequate reclamation bond. <br />The file and permit number is M-2000-149. Eric Scott and Assistant Attorney General Jeff <br />Fugate appeared on behalf of the Division of Reclamation, Mining and Safety ("Division"). <br />Brian Barton appeared on behalf of Dumb and Dumber Trucking, LLC (the "Operator"). <br />This matter was originally heard at the February 10, 2010 Board meeting and <br />concerns the financial warranty for the Barton Pit, located in Logan County, Colorado. In <br />February, after testimony concluded, the matter was continued to the March 10, 2010 Board <br />meeting. In March, the matter was again continued until the April 14, 2010 Board meeting. <br />The Board granted the continuances to provide additional time for the Operator to obtain <br />adequate bonding for the site. The continuances were granted orally during the Board <br />hearings and no written Orders were issued. The Board grants another continuance until <br />June 9, 2010 and issues this written Order. <br />Mr. Barton said during the April 14 hearing that he is in the process of selling the <br />Barton Pit property. He also said that if the sale is not progressing within one month (from <br />the April 14, 2010 hearing date) that he would knock down the pit's high wall. At the April <br />hearing, the Board granted a two-month continuance. <br />ORDER <br />This matter is continued until the June 9, 2010 Board meeting. <br />Dumb and Dumber Trucking, Barton Pit <br />M-2000-149
