Ill,_GO MENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> to be a "Prime Farmland Soil". Therefore, the rules and permit do not require that every <br /> cubic yard of this material be returned to the Morgan property. <br /> • Bench 1 thicknesses north of the Morgan parcel (WFC and Lloyd) are somewhat less than <br /> those found on Morgan, but are nonetheless sufficient to provide the 2-foot and 3-foot <br /> thicknesses, respectively, of "suitable subsoil" required by the reclamation plan for these <br /> areas. There would be no need to supplement with Bench 1 material taken from the <br /> Morgan parcel. <br /> Backfill & Grading <br /> • The shovel was observed excavating overburden that had been blasted and loading it into <br /> haul trucks to be transported to the back side of the pit. A dozer was pushing shot material <br /> down to the pit floor (Photo 4). <br /> F-xnlosives <br /> • The drill rig was set up near the northern end of the active cut on property owned by WFC <br /> (Photo 5), and was not in operation at the time of the inspection. A pattern of holes had <br /> been already drilled, and gravel for stemming was stockpiled nearby. The next shot was <br /> scheduled to take place the following day. <br /> Topsoil <br /> • Topsoil thicknesses visible at the excavation face ahead of the pit operations on WFC land <br /> ranged from 0" (atop a rocky outcrop, Photo 6) to approximately 18" (A and B lift <br /> combined). <br /> • Several acres at the eastern end of the Morgan property (the first area mined and <br /> backfilled) were topsoiled in 2006, prior to the replacement protocols established in 2008 <br /> and formalized with TR-57. The current requirement is that a minimum of 22" of Mixed A and <br /> B topsoil be placed on Morgan (Prime Farmland) property disturbed prior to February 2008. <br /> Depth data reported in Annual Reclamation Reports for the mine indicate that only 1.4 feet <br /> (17 inches) of topsoil was placed in 2006. Tom Fry dug a hole in this area during this <br /> inspection (Photo 7) and we observed the thickness of topsoil to be 17 to 18 inches. Topsoil <br /> for this area will need to be supplemented with additional thickness in order to comply with <br /> the reclamation requirements of the permit. <br /> Revegetation <br /> • The CCC Ditch had not yet been turned on, but reclaimed areas throughout the permit area <br /> were greening up with new growth due to the relatively wet winter and spring. <br /> • Portions of the Lloyd property seeded in the fall of 2009 were sprouting. Seed mixes used on <br /> Lloyd's parcel were dryland pasture (for Dryland Pasture postmining land use) and winter <br /> wheat (for Irrigated Pasture postmining land use). <br /> Air Resource Protection <br /> • A water truck was in operation, spraying the haul road located to the east of the southern <br /> end of the pit. <br /> New Horizon Mine C-1981-008 15-Apr-2010 <br /> -2- <br />
