(Page 2) <br />MINE ID # OR PROSPECTING ID # M-2009-023 <br />INSPECTION DATE 4/1/10 <br />INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This inspection occurred in response to a request from the Operator for an on-site meeting to discuss a <br />potential change to the permit to construct approximately four acres of wetlands. The proposed wetlands <br />are intended to replace existing wetlands which will be impacted by the construction of a nearby <br />reservoir. The proposed wetlands would include approximately four acres area and would be located <br />within the boundary of lands previously affected by mining activities. The Division had been previously <br />approached by Ryan Unterreiner, with Bikis Water Consultants, (970) 385-2340, representing the La <br />Plata Water Conservancy District, regarding this matter. <br />Operations conducted under a previous 111 permit at this site (M-1999-086) had exposed ground water. <br />A pond of approximate five acres surface area had resulted from the previous excavation. Permit <br />records include a correspondence from Division of Water Resources, dated January 3, 2002, which <br />indicates the pond is compliant with Colorado water laws and regulations governing injury to existing <br />water rights. However, permit conditions for the existing 112 permit clarify that additional groundwater <br />will not be exposed. Therefore, if the Operator desires to construct wetlands, and in doing so must <br />expand the current area of exposed ground water, the Operator must amend the permit to address this <br />change. Pursuant to Rule 3.1.6(1)(a), the amendment must demonstrate a legal right to expose the <br />ground water. <br />If the Operator must discharge pit drainage, as necessaryto suppress the water table during construction <br />of the proposed wetlands, a Colorado Discharge Permit System permit may be required from the Water <br />Quality Control Division of the Colorado Department of Public Health and Environment. Pursuant to Rule <br />3.1.6(1)(b), the Division requires that the proposed operation be compliant with water quality laws and <br />regulations. <br />The proposed project may require permitting through the US Army Corps of Engineers, who may have <br />jurisdiction regarding the construction of the wetlands. <br />Therefore, the Division recommends that the Operator submit the proposed change for review through <br />the Amendment process, as described under Rules 1.1(6) and 1.10. <br />Reclamation appeared to have been completed for portions of the permit area located nearby the pond. <br />Release of these areas, as well as the process whereby the area proposed for wetlands construction <br />could be released from the permit, was discussed. <br />Response to this inspection report should be directed to the Division's office in Durango at 691 County <br />Road 233, Suite A-2, Durango, CO 81301, to the attention of Wally Erickson, phone (970) 247-5469. <br />I & E Contact Address <br />NAME Craig Wickstrom <br />OPERATOR Skanska USA Civil West RMD <br />STREET P.O.
