6.4.4 EXHIBIT D - Mining Plan <br />7.) It appears the site will be mined in six distinctive cells. At this time, there appears to <br />be mining occurring in cell C1 and cell B. Based on the current pit excavations please <br />provide a sequence/schedule for each mining cell for slurry wall instillation, <br />embankment/dam construction, and when each cell will be mined? This information <br />will be very important when it comes to calculating a proper bond. <br />8.) Enclosed with this review is a letter from Weld County in regards to the placement of <br />fill Within the flood plain for the construction of the embankments. The Federal <br />Emergency Management Agency (FEMA), require a Conditional Letter of Map Revision <br />(CLOMR) to be approved prior to the placement of fill in the floodplain. Prior to the <br />Division's approval of the amendment, the applicant must submit evidence they have <br />received FEMA approval. <br />9.) The applicant will likely need approval from the Office of the State Engineer (SEO) to <br />construct the embankments which may be considered jurisdictional dams. Given the <br />major component of this amendment application is the construction of these dams; <br />prior to the Division's approval of the amendment, the applicant must submit evidence <br />they have received SEO approval for the design of the dam/embankments and that the <br />designs for these embankments match what the Operator has proposed in the <br />amendment application. <br />10.) What depth will the overburden be stripped? Please describe the type/nature of <br />the overburden. <br />11.) What depth will the topsoil be stripped? <br />12.) Please indicate where the topsoil piles will be located on the Exhibit C map. <br />13.) There are two cross-sectional drawings depicting the dam/embankment; "Dam <br />typical Section A" and "Dam typical Section B". Please explain when each specific design <br />will be used. <br />14.) For the currently un-mined areas. Prior to the exposure of ground water, please <br />commit to installing the slurry wall and obtaining SEO certification that the slurry wall <br />will perform in accordance with their.standards. Please commit to supplying evidence <br />of SEO approval of the slurry wall to the Division prior to the exposure of ground water. <br />6.4.5 EXHIBIT E - Reclamation Plan <br />15.) The reclamation plan states the embankments will be up to 40 feet in height, <br />however the mining plan and the Exhibit C maps indicate the embankments will be 30 <br />feet in height, please clarify.
