(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1977-223_ <br />INSPECTION DATE: d/UlQ INSPECTOR=S INITIALS: MAC- <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Joe Gagliano of LJ Development, Inc. and Thane Milenski of Five Rivers Ranch were also present <br />for the inspection. The Wiley Pit is located approximately 1.9 miles south of Wiley, CO. The site is permitted <br />for 86.60 acres and the post-mining land use is general agriculture. <br />This inspection :vas conducted in response to an Amendment Application submitted to the Division on February <br />26, 2010. The Amendment Application was filed for review on March 12, 2010; the Division is currently <br />reviewing the Amendment Application and the decision date is June 10, 2010. The Wiley Pit Construction <br />Material Reclamation Permit is being amended to increase the permit area from 86.60 acres to 174.60 acres. In <br />addition, the post-mining land use is being amended from general agriculture to developed water resource. <br />The permit sign was posted on the existing service road, which leads to the pit from the south entrance. The <br />permit boundary of the affected area was clearly delineated with monuments. The current excavation is <br />approximately 5.5 acres and has been mined to a depth of ± 20'. The Applicant is proposing to increase the size <br />of the pit to 20 acres, with an additional 130 acres used for stockpiling and processing. The site will be dry <br />mined and groundwater will not be exposed. Onsite processing will include a crushing and screening plant. <br />Upon completion of mining, the pit will be lined with clay to create a water storage reservoir. In addition, the <br />amended Reclamation Plan calls for installing an open drainage channel, which will capture and divert water <br />from the west side of the permitted area to the reservoir. Water will be conveyed from the reservoir to the Five <br />Rivers Cattle Ranch on the south side of US Highway 50 via pipeline that will terminate at the Amity Canal. <br />The water pipeline has been included in the affected area. The Applicant did not list all of the permanent man- <br />made structures that are within 200 feet of the affected area. An existing water line on the south side of US <br />Highway 50 and US Highway 50 will need to be listed under Exhibit S - Permanent Man-Made Structures. <br />The Applicant has not provided the Division with construction and design specifications for the reservoir, the <br />construction and design specification will need to be submitted prior to the decision date. The Division currently <br />holds a Financial Warranty in the amount of $48,200.00. Once all of the Division's adequacy concerns have <br />been addressed, the reclamation liability amount will be recalculated and a new Financial Warranty estimate <br />will be sent to the Operator under separate cover. <br />No observations were made during this inspection that would prevent the approval of the Amendment <br />Application.
