R <br />Rex M & Sharon A Hiner <br />11 Austin Road <br />Lamar Colorado 81052 <br />April 16, 2010 <br />State of.'Colorado <br />Division of Reclamation, Mining & Safety <br />Department of Natural Resources <br />1313 Sherman Room 215 <br />Denver Colorado 80203-2273 <br />ATTN Michael Cunningham <br />RE: Greeley Pit M-1977-151 <br />Weld County Colorado- <br />Mr Cunningham: <br />In reference to your Inspection Report you signed on March 25, 2010 showing <br />problems and/or possible violations and corrective actions: <br />Richard T Raines with Applegate Group told us we could backfill the 5.7 acre <br />lake and trade that for new lake area - Richard quit with Applegate and is now <br />employed by the City of Greeley. <br />Now Jared Dains of Applegate works with us, replacing Raines. <br />Jared ask us to wait - he did not think that was true, so we have done what <br />Jared ask. We want to be credited for the area to off-set augumentation. <br />As everyone knows, there have been many owners of this mine and we do not know <br />what they might have had in mind, but to revert back to the original permitting <br />of this mine permit, this is a way to make it more water ski-able and the new <br />area that is being taken out, that part has been mined before but only 15 foot <br />deep. Some of it is where the plant set and has never been mined. We intend <br />to take that out to make it ski-able making approximately 8 to 10 foot deep <br />below the water level. There is much more material there that can be gotten <br />out at a later date by a dredge. At this time we are working towards making <br />it ski-able. <br />Jared is currently assisting us in obtaining a well permit and substitute <br />water supply plan. We currently own one share of the Greeley Irrigation Company <br />water and are inquiring on purchases of additional water that will be used as <br />temporary water until it will later be exchanged to permanent augumentation <br />water. We are also in the process of leasing water for the short term water <br />needs. <br />On the enclosed map: <br />The orange strip area is what Richardson is planning on taking out in 2010. <br />The solid orange is what Hiner started backfilling in error and now intends <br />to take that material and put it in the green area to off-set augumentation. <br />The pink area we will put off doing anything with at this time but some time <br />in the future will want to take it out to better utilize that portion of the <br />property. <br />The reclamation on the property is complete except the yellow area - this is <br />the only area that has not been reclaimed. <br />The green area - will it be credited against the augumentation?
