C
P-liPR 1 % 2010
X2 Division of Reclamation,
Mining & Safety
6101'! R
Rex M & Sharon A Hiner
11 Austin Road
Lamar Colorado 81052
April 16, 2010
State of.'Colorado
Division of Reclamation, Mining & Safety
Department of Natural Resources
1313 Sherman Room 215
Denver Colorado 80203-2273
ATTN Michael Cunningham
RE: Greeley Pit M-1977-151
Weld County Colorado-
Mr Cunningham:
In reference to your Inspection Report you signed on March 25, 2010 showing
problems and/or possible violations and corrective actions:
Richard T Raines with Applegate Group told us we could backfill the 5.7 acre
lake and trade that for new lake area - Richard quit with Applegate and is now
employed by the City of Greeley.
Now Jared Dains of Applegate works with us, replacing Raines.
Jared ask us to wait - he did not think that was true, so we have done what
Jared ask. We want to be credited for the area to off-set augumentation.
As everyone knows, there have been many owners of this mine and we do not know
what they might have had in mind, but to revert back to the original permitting
of this mine permit, this is a way to make it more water ski-able and the new
area that is being taken out, that part has been mined before but only 15 foot
deep. Some of it is where the plant set and has never been mined. We intend
to take that out to make it ski-able making approximately 8 to 10 foot deep
below the water level. There is much more material there that can be gotten
out at a later date by a dredge. At this time we are working towards making
it ski-able.
Jared is currently assisting us in obtaining a well permit and substitute
water supply plan. We currently own one share of the Greeley Irrigation Company
water and are inquiring on purchases of additional water that will be used as
temporary water until it will later be exchanged to permanent augumentation
water. We are also in the process of leasing water for the short term water
needs.
On the enclosed map:
The orange strip area is what Richardson is planning on taking out in 2010.
The solid orange is what Hiner started backfilling in error and now intends
to take that material and put it in the green area to off-set augumentation.
The pink area we will put off doing anything with at this time but some time
in the future will want to take it out to better utilize that portion of the
property.
The reclamation on the property is complete except the yellow area - this is
the only area that has not been reclaimed.
The green area - will it be credited against the augumentation?
