The lagged accretions to the Cache la Poudre River are estimated <br />to total 629.02 acre-feet for this approval period (includes carry over from recharge in previous years). <br />The Three Bells site was continuously dewatered at a rate of 1,200 gallons per minute. The <br />timing of the lagged depletions from the dewatering operation was determined through a stream <br />depletion model for the Three Bells Pit. The model addresses the lagged depletions at the East Rigden <br />Pit, Kyger Pit, Port of Entry Pit, Weitzel Pit, and Shield Mine by accounting for the net accretion credits <br />at the river that occur due to the dewatering operation at the Three Bells Pit. These accretions are <br />applied to this plan against depletions from the East Rigden Pit, Kyger Pit, Port of Entry Pit, Weitzel Pit <br />and Shield Mine. The attached Appendix F summarizes the accretion credits from dewatering at the <br />Three Bells Pit. <br />During the Water Year 2010, a lease from the City of Greeley ("Greeley") will make replacements <br />for depletions not covered by the recharge program. A lease of 12.35 acre-feet of fully consumable <br />water from Greeley will make replacements in February and May 2010. Lafarge West, Inc. ("Lafarge") <br />traded their 550 shares of the Boyd and Freeman Ditch with Greeley for a perpetual lease of 125 acre- <br />feet per year. The 35th Avenue Pit SWSP approved on December 20, 2009 is using 88.7 acre-feet under <br />the trade agreement. A portion of the remaining was will be used under this SWSP to cover the <br />replacement for depletions in February and May 2010. Information received from Greeley on April 8, <br />2010 confirmed that Greeley will be provided approximately 11 acre-feet of replacement water in May <br />2010 to cover the remaining depletions not covered by the recharge program. Also according to the <br />information provided on April 13, 2010, Greeley released 3.2 acre-feet in February for this SWSP. Only <br />1.37 acre-feet were required to be released for February for this SWSP, however 3.2 acre-feet were <br />released because Lafarge did not recharge the amount anticipated in October 2009 and extra amount of <br />water was needed to cover the month of February 2010 shortage. <br />A monthly breakdown of the stream depletions from the mining operations as well as the <br />replacements is shown in the attached Table 1. <br />Conditions of Approval <br />I hereby approve the proposed substitute water supply plan in accordance with Section § 37-90- <br />137(11), C.R.S. subject to the following conditions: <br />1. This plan is approved with an effective date of November 1, 2009 and shall be valid through October <br />31, 2010 unless otherwise revoked or modified. If this plan will not be made absolute by a water <br />court action by the plan's expiration date, a renewal request must be submitted to this office with the <br />statutory fee (currently $257/pit) for each gravel pit no later than September 15, 2010. <br />2. The total area of pond surface exposed for each of the pits shall not exceed those values listed in <br />Table A of this approval. Should the total surface area exposed exceed those amounts, an <br />amendment request shall be promptly filed with this office. <br />3. The total amount of ground water to be appropriated from each of the pits shall not exceed the <br />values listed in Table B of this approval. <br />4. Approval of this plan is for the purposes as stated herein. Any additional uses of this water must <br />first be approved by this office. Any future additional historical consumptive use credit given (e.g., . <br />agricultural water transfer) for this site .must consider all previous credits given.
