Cattany <br />Division Director <br />Natural Resource Trustee <br />On April 6, 2010, the Division determined the above referenced application to be complete for the <br />purposes of filing. All comment and review periods began on April 6, 2010. The decision date for your <br />application is scheduled for May 6, 2010. <br />Pursuant to Hard Rock/Metal Mining Rules 1.6.2(1)(d) and 1.6.3(3), within ten days of filing you must <br />publish a notice in a newspaper of general circulation in the locality of the proposed mining operation. As <br />noted previously by the Division in its March 25, 2010 correspondence, the notice proposed by the <br />Applicant incorrectly represented the Applicant as Mr. Mike Clements rather than Wildcat Mining <br />Corporation. Please ensure that such error is corrected prior to publication in the local newspaper. <br />Pursuant to Rule 1.6.2(1)(e), immediately after the publication, mail or personally serve a copy of the <br />notice to all owners of record of surface and mineral rights, holders of any recorded easements, and all <br />owners of record of lands that are within 200 feet of the boundary of the affected land. Proof of notice <br />and mailings, such as Certified Mail, Return Receipt Requested, must be submitted to the Division prior to <br />the decision date. Additionally, any changes or additions to the application on file in our office must also <br />be reflected in the public review copy, which has been placed with the La Plata County Clerk and <br />Recorder. <br />The Division is reviewing your application to determine whether it is adequate to meet the requirements <br />of the Act. Several issues previously raised by the Division in its March 25, 2010 correspondence, <br />regarding the blasting demonstrations required under Rules 6.3.3(1)(o) and 6.5(4), and a justification for <br />final slopes being steeper than 3H:1V, as required under Rule 6.3.4(1)(b), will be more fully explored and <br />resolved during the review period.
