The Division has reviewed Blue Mountain Energy's (BME) application for a minor revision, MR143. Minor
Revision No. 143 provided designs and modeling of proposed changes to the Pond DR-1 riser, modifications
to a federal coal lease, and changes to the location of a water pump and waterline route located at the Raw
Water Lagoon.
The Division's estimate of reclamation costs associated with the proposed changes was $3, 237.00. A copy of
the Division's estimate is attached to this letter.
The Division is in agreement with the design modeling BME provided for the change to the DP-1 riser design.
The Division has one item that needs additional information:
1. In accordance with Rule 2.05.3(4)(a)(ii)(c), please describe in the permit text how the gate on the
weep hole will be operated, under what conditions will it be closed, if any, and a commitment to
sample all manual discharges in accordance with the approved CDPS permit. The existing page IV-39
in the PAP would be a logical place to add this text.
The proposed decision date for MR143 is April 15, 2010. Please provide this information as soon a possible
in order to meet the regulatory permitting timeframe.
