I <br />INTERNAL MEMORANDUM <br />DATE: August 27, 2007 <br />TO: Sandy Brown and Steve Renner <br />FROM: Dan Mathews <br />RE: Fruita Mine Reclamation Project <br />I inspected the permit revoked Fruita Mine site on Friday, which reminded <br />me that we need to get the wheels turning to develop a reclamation project <br />with the remaining monies available, a total of $17,794.00 (15k from OSM <br />civil penalty monies and the remainder left over from the original forfeited <br />bond amount). <br />Sediment Pond Spillway Concerns <br />I had originally worked with Paul Krabacher in December 2005, to develop <br />plans for repair of a defective spillway gate device and to lower the elevation <br />of the open channel emergency spillway. This was when we only had the <br />$2,794.00 from the original bond to work with. These plans never got fully <br />fleshed out, because of some unfortunate scheduling and communication <br />issues. At that time, I had a couple concerns with the sediment pond. These <br />concerns were: <br />1) There was a defect near the bottom of the primary spillway riser pipe, <br />which allowed any inflow to immediately drain out of the pond. The defect <br />was determined to be a rubber seal on a metal gated dewatering device that <br />had apparently rotted off, leaving a 1 /2" gap behind the gate, even when it <br />was closed. This defect was originally buried below 2 or 3 feet of sediment, <br />but resulted in piping erosion that dewatered the pond with no retention <br />
