REQUEST FOR CIVIL PENALTY FUNDS <br />FY 2008 <br />Date of Request: January 30, 2008 <br />Type of Request (Check one): X Annual _Emergency <br />Regional Director Name /Signature: James Fulton, Director <br />Coordinating Center: Western Coordinating Center <br />Purpose /Summary of Project: The purpose of this project is to complete <br />reclamation of the Fruita Number 1 and 2 Mines, a bond revoked coal mine in <br />Mesa County Colorado. <br />The Fruita Number 1 and 2 Mines was a permitted site where the reclamation bond was <br />forfeited by the Colorado Mined Land Reclamation Board. Most of the forfeited bond <br />has been used to fund previous reclamation tasks at the site. The site is located within a <br />dynamic canyon, subject to periodic intense flash flooding. Therefore, structural stability <br />issues within a drainage channel designed to pass large volume flash flood events through <br />reclaimed portions of the site may lead to failure of this channel. Failure of the channel <br />will result in irreparable damage to significant portions of the reclaimed mine site. <br />Further, the sole sediment retention pond for the site is located within the confines of this <br />drainage. The pond requires modifications and repair to ensure its long term stability, <br />and to ensure the safety of the general public. Other slope and soil stability issues at the <br />site will be addressed through erosion control work and revegetation. <br />The Colorado Division of Reclamation, Mining and Safety estimates that $55,000 is <br />necessary to accomplish the scope of work required at this site. DRMS holds $2,794 in <br />revoked bond, and $15,000 from a Civil Penalty grant awarded in 2007. We are <br />requesting a grant award in the amount of $35,000 to cover the projected funding deficit. <br />All of the funds will be used for site reclamation work. The State will absorb the <br />administrative and project management costs associated with completing the work. <br />2.
