PUBLIC NOTICE <br />The Colorado Division of Minerals and Geology proposes to discontinue maintenance of an <br />existing sedimentation pond at the Fruita No. 1 and No. 2 Mine (File No. C-81 -015). The subject <br />site is an abandoned, bond forfeited underground coal mine located in Mesa County, <br />approximately 12 miles north of Fruita, at the base of the Bookcliffs. The mine site is located <br />within the NW1 /4NW1 /4 Section 29, and NE1 /4 Section 30; Township 8 South, Range 101 West, <br />of the 6"' Principal Meridian. Mesa County Road 18 provides access to the site. Surface <br />disturbance area is approximately 12 acres; the land is privately owned. <br />The Division is proposing to discontinue sediment pond maintenance, pursuant to Rule 4.05.2(2) <br />of the Regulations of the Colorado Mined Land Reclamation Board, promulgated under the <br />Colorado Surface Coal Mining Reclamation Act, Section 34 -33 -101, etseq., C,R.S. The decision <br />is proposed due to the fact that the disturbed area has been reclaimed, vegetative cover that <br />meets the approved standard has been established, and ground cover is adequate to stabilize the <br />site and prevent the contribution of additional suspended solids above natural levels. <br />The decision is based on vegetation cover sampling conducted May 17 -18, 2005, and a complete <br />mine site inspection conducted September 19, 2005. The Division has prepared a written finding <br />in support of the proposed decision. Copies of the written finding are on file for public inspection <br />at the Colorado Division of Minerals and Geology, Room 215, Centennial Building, 1313 Sherman <br />Street, Denver, Colorado 80203; at the Division's Grand Junction Field Office, 101 South 3` <br />Suite 301, Grand Junction, Colorado 81501; and at the Mesa County Clerk's Office, 6"' and Rood, <br />Grand Junction. Persons with an interest that may be adversely affected by the proposed <br />decision may submit written comments to the Division at the Denver address. Comments must <br />be received by the Division within thirty (30) days of publication of this notice.
