Shelton (!1cz? , -4 <br /> Director <br /> Mined Land Reclamation Division <br /> 423 Centennial Building <br /> 1313 Sherman Street <br /> Denver , Colorado 80203 <br /> Re: Letter of Credit No. <br /> American Shield Coal Company - Fruita Properties <br /> Permit # - 76-60 <br /> Dear Mr. Shelton: <br /> As you know, InterFirst Bank - Dallas ("the Bank") has <br /> issued the above-referenced Letter of Credit in support of the <br /> reclamation bond submitted by American Shield Coal Company for the <br /> above-referenced- permit. This letter is written to advise you <br /> that the Bank will provide written notice to the Colorado Mined <br /> Land Reclamation Division as soon as possible after the Bank <br /> learns of any of the following events: <br /> 1. The receipt by the Bank of any notice or action <br /> filed alleging the insolvency or bankruptcy of the <br /> Bank, or alleging any violations of regulatory <br /> requirements .which could result in suspension or <br /> revocation of the Bank' s charter or license to to <br /> business; and <br /> 2. The occurrence of any event by which the Bank <br /> becomes unable to fulfill its obligations under the <br /> Letter of Credit. <br /> The designated loan officer with responsibility for American <br /> Shield' s account will make all the necessary inquiries with other <br /> bank representatives so as to facilitate his ability to provide <br /> the notice specified in this letter. <br /> We believe that this commitment to give notice represents <br /> the final step necessary to allow the Mined Land Reclamation <br /> Division to approve the Letter of Credit supporting American <br /> Shield' s permit for the Fruita properties. <br /> Please contact us if you have any further questions <br /> concerning this letter. <br /> Very truly yours, <br /> InterFirst Bank - Dallas <br /> BY: <br /> t <br />
