III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Topsoil <br /> • In the southwest corner of the Benson-West parcel, a single pile of "Mixed" topsoil (Stockpile <br /> 14) still remains. The 2009 Annual Reclamation Report gives the volume of the pile as 9,410 <br /> cubic yards. <br /> Fish &Wildlife <br /> • Pond 007 continues to be an inviting stop for migratory birds. Numerous snow geese were <br /> gathered on the bank in the northwest corner of the pond, along with several Canada <br /> geese (Photo 2). <br /> Reveaetation <br /> • Grasses on the reclaimed "Rice Tract" in the NH 1 permit area were just beginning to green <br /> up. <br /> • It is anticipated that the recent series of spring storms will provide a boost to all reclaimed <br /> areas,including those seeded in the fall of 2009. <br /> Air Resource Protection <br /> • Due to the damp to wet ground conditions, the water truck was not in operation at the time <br /> of the inspection. <br /> Reclamation Success <br /> • Ross pointed out the likely locations of buried irrigation lines that will be installed to provide <br /> water to the Benson-West and Lloyd parcels. The main line will parallel the (future) BB Road <br /> alignment west of 2700 Road, and turn northward (uphill) near the Lloyd-Benson property <br /> line. Gated pipe will be installed, and irrigation will be accomplished with gravity flow to the <br /> west. A tailwater ditch will be constructed across the downstream side of the irrigated <br /> portion to direct flow away from DP areas below. Reclaimed portions of the Lloyd parcel <br /> have been previously seeded with the Dryland Pasture seed mix; those portions that will be <br /> irrigated will be re-seeded with an Irrigated Pasture mix. <br /> • A number of cow/calf pairs were grazing on the Irrigated Pasture reference area located in <br /> the southeast corner of the permit (Photo 3). <br /> Prime Farmland <br /> • No prime farmland topsoil hauling or placement operations were occurring at the time of <br /> the inspection. <br /> • An erosional feature was visible on the southwestern corner of the "Lift B" topsoil stockpile <br /> (Photo 4). This was likely the result of recent snowmelt runoff collecting on top of the pile and <br /> bursting through the outer berm. WFC had already noted the problem and had directed <br /> the reconstruction of the containment berm at the base of the pile to guarantee there <br /> would be no loss of topsoil resource. <br /> New Horizon Mine C-1981-008 17-Mar-2010 <br /> -2- <br />
