C- 1991 -078 TR -09 <br />Adequacy Review <br />13 August 2009 <br />Page 3 of 3 <br />For the evaluation of water quality in the pond, the CDPHE, Water Quality Control <br />Commission — Agricultural Standards for Surface Water should be used as the <br />testing parameters. These are deemed to be the most appropriate and applicable <br />standards for a permanent stock pond that is intended to be primarily used for <br />livestock watering. Agriculture (state use classified) surface waters are defined as <br />suitable or intended to become suitable waters for irrigation of crops usually grown <br />in Colorado and which are not hazardous as drinking water for livestock. To show <br />compliance with 4.059(13) (a), the operator should demonstrate that the impounded <br />water is of suitable quality for livestock watering. <br />Please provide a laboratory analysis (if this has not already been previously <br />provided) and a comparison of the pond water quality with the Agricultural <br />Standards for Surface Water. Please incorporate the requested information into <br />the revision application materials. <br />6. Since Pond B is now being requested as a permanent postmine feature, the operator <br />should aggressively implement the approved weed control plan and control the <br />growth of Tamarisk and other weeds that have been recently reported in DRMS <br />inspections of the area in and around Pond B. <br />7. The last sentence of the first paragraph on revised page 2.05 - includes an <br />extraneous "be'; which should he deleted. <br />The second sentence of the fourth paragraph on revised page 2.05 -8 of the <br />application is at odds with the changes proposed with TR -09. Please revise this <br />sentence to refer to "temporary" impoundments only. <br />This concludes the Division's Preliminary Adequacy Review for TR -09 for the Hamilton <br />Mine.
