Erosion due to potential future high flow velocities will be minimized by continuing to <br />route surface runoff through pipes instead of by ditches. <br />• Leaving the pipes in place will not change the overall drainage patterns of the area, <br />and as indicated in Section 4.05.4 of the CDRMS Rules, permanent channel <br />diversions, including artificial controls, may be installed if approved by the Division. If <br />the pipes were left in place, the downstream discharge would be rerouted to flow <br />directly toward the river instead of to the sedimentation pond, thereby restoring the <br />natural drainage pattern after sediment pond removal. <br />4. CDRMS Comments 11(a) and (b): Please add to Section 8.1 the following commitments: <br />a. After final reclamation is complete, a technical revision will be submitted that <br />demonstrates routing of surface runoff from the RPE East to a sediment control pond is <br />no longer needed for complying with water quality regulations. <br />Response: Text has been added to Section 8.1 indicating that a technical revision will <br />be submitted upon completion of final reclamation to demonstrate that the sediment <br />control pond is no longer needed to comply with water quality regulations. <br />b. Upon approval of the previously mentioned technical revision, the east and west <br />sediment drainage pipes and manhole covers will be removed, and the perimeter of the <br />refuse pile will be re-graded so that surface drainage is routed to 100-year clear water <br />ditches. <br />Response: As indicated in the response #3 above, MCC intends that the sediment pipe <br />infrastructure will remain in place and continue to route surface water runoff from the <br />refuse pile after final reclamation. <br />Please let me know if you have further question or require additional information to address your <br />comments. <br />xathy `Weft, <br />Environmental Engineer III <br />Mountain Coal Company, LLC <br />West Elk Mine <br />P.O.
