III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a Partial Inspection of the Hamilton Mine conducted by Marcia Talvitie of the Colorado <br />DRMS beginning at 4:00 p.m. on Wednesday, 17 March 2010. No representative of the operator <br />was present during the inspection. Skies were clear and the temperature was mild (for March). <br />The area had received a very wet spring snowstorm during the previous weekend, and the <br />ground surface was damp to wet throughout the permit area. <br />Current Permitting Activities <br />An application for TR-09, retention of Pond B as a permanent impoundment, was submitted <br />in July 2009. The Decision Date was extended to 30-Apr-2010 in order to allow opportunity for <br />sampling and laboratory analysis of water stored in and discharged from Pond B. <br />SL-02, which requests Phase II bond release for 86.8 acres, was called Complete for purposes <br />of filing in December 2009. The Division has not yet completed its adequacy review of the <br />application. We anticipate holding the bond release inspection in late spring 2010. <br />Roads <br />• Roads within the permit area were damp to muddy, but overall in good condition and <br />passable by vehicle. <br />Hydrologic Balance <br />Sedimentation Ponds A and B were both dry, which was somewhat surprising, given the <br />amount of precipitation (snow and rain) that has fallen in the area this winter. Storms have <br />been intermittent, and the snow has melted between events, rather than accumulating on <br />the ground. <br />During the February inspection, some burrowing disturbance at the eastern end of the dam <br />for Pond B was observed and noted. It appeared during the current inspection that there <br />has been no additional disturbance, but the site should continue to be monitored. <br />Hamilton Mine C-1991-078 17-Mar-2010
