Box 456 <br />Montrose, CO 81402 <br />RE.: Nuvemco's Last Chance Mine, Permit #M-2008-012; Stormwater <br />Management Plan, Detention Ponds, and 72-hour Release Requirement <br />Dear Mr. Hurford, <br />Pursuant to our conversation last week, please confirm that because Nuvemco is making <br />no beneficial use of precipitation, and is required by DRS and CDPHE to confine, or <br />contain storm water run-off from uranium waste rock and temporary ore stockpiles, no <br />water rights are required. Located on Davis Mesa in western Montrose County, <br />Nuvemco's Last Chance Mine will have a waste rock dump of less than I acre with run- <br />off directed to two unlined sediment traps that may retain water more than 3 ) days before <br />the water is dissipated into the ground or evaporated. Similarly, the storm water run-off <br />from the temporary ore stockpile and loading area of about 0.46 acres is directed back <br />into the mine for total containment in accordance with DRMS and CDPHE regulations. <br />Overflow runoff from sediment traps could travel ephemeral drainages that only flow <br />with major summer storms or snow melt and are over 4 miles from the Dolores River, the <br />nearest live stream. <br />Thank you for your assistance in this matter. <br />Sincerely, <br />E.
