engineem
DRMS, Response Supplement (4)
April 2. 2010
Mr. Bob Hurford
Colorado Division of Water Resources/Division 4
P.O. Box 456
Montrose, CO 81402
RE.: Nuvemco's Last Chance Mine, Permit #M-2008-012; Stormwater
Management Plan, Detention Ponds, and 72-hour Release Requirement
Dear Mr. Hurford,
Pursuant to our conversation last week, please confirm that because Nuvemco is making
no beneficial use of precipitation, and is required by DRS and CDPHE to confine, or
contain storm water run-off from uranium waste rock and temporary ore stockpiles, no
water rights are required. Located on Davis Mesa in western Montrose County,
Nuvemco's Last Chance Mine will have a waste rock dump of less than I acre with run-
off directed to two unlined sediment traps that may retain water more than 3 ) days before
the water is dissipated into the ground or evaporated. Similarly, the storm water run-off
from the temporary ore stockpile and loading area of about 0.46 acres is directed back
into the mine for total containment in accordance with DRMS and CDPHE regulations.
Overflow runoff from sediment traps could travel ephemeral drainages that only flow
with major summer storms or snow melt and are over 4 miles from the Dolores River, the
nearest live stream.
Thank you for your assistance in this matter.
Sincerely,
E.
