Sorensen's last paragraph addresses water rights associated with beneficial use. Nuvemco agrees <br />to not beneficially use any precipitated run -off in the mine or from sediment traps for drilling or <br />dust control. BCI reviewed the 72 -hour release requirement for detention and retention ponds <br />associated with the Last Chance Mine with Mr. Bob Hurford, of the Colorado Division of Water <br />Resources/Division 4. BCI was assured that given the location, the small volumes of water <br />precipitated, and the feudal nature of any downstream calls, that Nuvemco did not need a water <br />right for retention of surface roan -off from the waste rock or temporary ore stockpile and loading <br />areas of the mine. A letter requesting confirmation of this understanding has been sent to Mr. <br />Hurford and is enclosed as DRMS Response Supplement (4). <br />19 <br />
