a ? <br />R? z <br />APR 12 2010 <br />Rex M & Sharon A Hiner <br />11 Austin Road <br />Lamar Colorado 81052 <br />April 6, 2010 <br />State of Colorado J'O LV,-jng and S&" <br />Division of Reclamation, Mining & Safety <br />Department of Natural Resources <br />1313 Sherman Room 215 <br />Denver Colorado 80203-2273 <br />ATTN Michael Cunningham <br />Mr Cunningham: <br />RE: Greeley Pit M-1977-151 <br />Weld County Colorado <br />This is a rough draft of the letter Rex ask me to type with regards to us needing <br />suggestions from you: <br />We are in receipt of your Inspection Report you signed on March 25, 2010 showing <br />problems and/or possible violations and corrective actions. <br />We want to inform you that Rex did come to the State Engineering office in Denver <br />and he talked to Ioana regarding the lakes, as you had suggested he do when you <br />visited our Greeley office on March 16th. <br />In regards to the 'problems' on page 4 of your letter: <br />1. Enclosed is a map of the lakes which shows the current configuration of the <br />lakes. In the Southwest lake along the east side, we have colored the affected <br />area yellow and believe approximately 3 acres will be changed. In the Southeast <br />lake along the northern edge, we have colored the affected area yellow and believe <br />1/4 to 1/2 acre will be changed. <br />2. Mr Jared Dains of The Applegate Group Inc is currently assisting us in obtaining <br />A well permit and substitute water supply plan. We currently own one share of <br />Greeley Irrigation Company water and are inquiring on purchases of additional water. <br />that will be used as temporary water until it will later be exchanged to permanent <br />augumentation water.
