(Page 2) <br />MINE ID # OR PROSPECTING ID #: u-9n 1n--nng <br />INSPECTION DATE: - 3/30/10 INSPECTORS INITIALS: MAC' <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Jesse Stackhouse of Washington County Road & Bridge District 2 was also present for the <br />inspection. The Colorado Land Board Pit is located approximately 15 miles north and 10 miles east of Otis, <br />Colorado. <br />This was a pre-operational inspection of a 112c Reclamation Permit. The permit application is currently under <br />Division review; the Division's decision date is May 23, 2010. The public notice sign was posted on the fence <br />along the south side of County Road 55. The boundary of the affected area has been delineated with <br />monuments. The site is located within portions of Rock Creek, a sandy bottomed ephemeral creek. The Rock <br />Creek was not flowing at the time of the inspection. The slopes range from 0-15% and the overall aspect is <br />north. The site is used for grazing cattle; cattle were present on the site during the inspection. The primary land <br />use of the surrounding area is rangeland and cultivated crop land; the proposed post-mining land use for the site <br />is rangeland. <br />Mining will begin in Rock Creek and will follow the creek bed. The site entrance and load out area will be <br />established on the level portions of the site, near County Road 55. The hydrologic balance will be affected <br />during the life of the mine, specifically surface flows within Rock Creek. As previously mentioned Rock Creek <br />is an ephemeral creek and only flow during periods of heavy precipitation. The main concern is that excavations <br />within the creek may lead to downcutting, resulting in potential impacts to County Road 55. The Division is <br />working with Washington County to identify ways to mitigate any potential impacts that would result from <br />mining within Rock Creek. <br />There are a limited number of structures within 200 feet of the affected area. An overhead powerline runs east to <br />west on the north side of County Road 55. The Operator will need to provide a letter from the utility company <br />that states mining and reclamation activities will have no negative effect on their utility. If the Operator cannot <br />obtain a letter from the utility company, then they may submit an engineering evaluation that demonstrates that <br />such structure shall not be damaged by activities occurring at the mining operation. <br />Based on this inspection, no observations were made that would restrict the approval of this application.
