III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DBMS.The Hawk's Nest Mine is a <br /> revoked mine site that was reclaimed with the forfeited bond money.Due to the fact that this mine is a revoked <br /> site,the inspection frequency was reduced to four quarterly inspections per year.Three of the quarterly <br /> inspections are partial and one is a complete.There are no mine records to check. The reclaimed mine site is <br /> divided into the east and west sections. <br /> East Mine Section <br /> The county road that cuts through the site was passable. The mud slide that is usually present did not quite reach <br /> the road.However,the mud did fill over the inlet of one of the two road culverts in the mine site area.The <br /> riprapped ditches below the two road culverts were in place.The riverside berm was in place.The vegetative <br /> cover was sparse on the east end and good on the west end.There was no snow on site but the ground was wet. <br /> The small depressions left in the backfilled and graded terrain were retaining the water. Since this is a revoked <br /> site,there are no mine id signs or surface disturbance markers. <br /> West Mine Section <br /> The entry to the west mine area,which actually is the road to the adjacent DMEA substation,was not blocked <br /> by railcars.There was a good stand of vegetation at the west mine area. The well cap was on the pvc pipe. <br /> Stream buffer zone signs were present that ran parallel to the river. <br /> There was a small amount of snow and standing water in the sediment pond. The pond embankment was well <br /> grassed and the single channel open spillway was clear of any blockage. Some trees had been cut down, <br /> presumably by the DMEA,at the east end of the pond and adjacent to the substation. <br /> c:/word2007/hawksnest/insp0310 <br />
